- Hookah Diving products sales are subject to the specific manufacturer's terms and conditions and subject to consumer law of the state of Queensland, Australia regardless of the location of delivery or customer's address.
The Customer agrees that any dispute with Hookah Diving Systems arising out of the Customer's purchase from Hookah Diving Systems shall be brought by the Customer exclusively in the state of Queensland; and the Customer hereby agrees that this arena is appropriate and that Hookah Diving Systems' agreement to sell and deliver products to the Customer to any location world wide is dependent on acceptance of this agreement. - Price of Hookah Diving Systems: Prices are listed in Hookah Diving Systems' brochures website and social media. HDS reserves the right to change prices without notice.
- Payment and Risk: Full payment is due before shipment. Payment to be made by Direct Bank Transfer and major credit cards (soon to be activated). The risk of loss for and title to the products purchased passes to the purchaser upon delivery to the carrier. The purchaser may choose to request and pay for insurance for the product while in the carrier's hand.
- Placing An Order: Simply fill in the contact form on the CONTACT page found in the menu and if ready to purchase we will send the invoice for payment. Orders are also accepted by phone and email, phone or in Person. Payment is by direct bank transfer or credit card ( coming Feb 24 ).
- Freight Terms. Shipping costs if applicable are notified at the time of invoicing. It is important to check at the time of ordering as conditions change. Freight is sent by air transport except within the country of delivery where is sent via road. A tracking number is supplied with expected delivery time between 5 and 21 days depending on the product and delivery location. Hookah Diving Systems shall not be held liable or responsible for loss caused by unforeseen delivery delays.
- Direct shipping: Hookah Diving Systems may ship the product directly from the factory in China or from the Australian head office. Any shipping costs, if not included will be agreed upon at invoicing. Costs, if any will be dependent on the delivery address of the purchaser.
- Export regulations: Products sold by Hookah Diving Systems, may be exported from Australia only in accordance with the Export Administration Regulations. Diversion contrary to Australia law is prohibited. Customer warrants and represents that it is eligible to receive Products under Australian law and agrees to abide by any export or re-export restrictions imposed by the manufacturer or publisher.
- The purchaser acknowledges that hookah diving can be dangerous and has risks of serious injury, even death and that using the hookah diving system is fully aware of these risks and uses the system entirely at his own risk.
- I acknowledge and agree that I am totally responsible for any person I allow to use my Diving compressor and they also have been made aware and can demonstrate safe use of the equipment do so at their own risk and the owner accepts full responsibility.
- LIMITATION OF LIABILITY. IN NO EVENT SHALL HOOKAH DIVING SYSTEMS, DIVEBUDDY or PORTAHOOKAH, ITS OWNERS, EMPLOYEES, SERVANTS, AGENTS, DIRECTORS, SERVICE AND REPAIR AGENTS, VENDORS AND SUPPLIERS WILL BE LIABLE FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INJURY OR DEATH, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT OR OPPORTUNITY OR BRAND from the use of the website, the purchase of or use of any Hookah Diving System's products specifically PORTAHOOKAH and DIVEBUDDY, as shown online or other medium. - General.(a) These Terms of Sale and any transactions made under them shall be interpreted by and be subject to the laws of the State of Queensland.

WARRANTY, GUARANTEES & RETURNS:
RETURNS: DIVEBUDDY: All returns to be authorized by Hookah Diving Systems within 7 days of the delivery date. Within 7 days notice of the purchase, we will replace or repair, at our sole discretion, any product that is deemed defective. After 7 days, the manufacturer's warranty process must be followed.
Please Note: Product returns other than for warranty are processed at the sole discretion of Hookah Diving Systems. Contact Hookah Diving Systems first! Refunds are decided case by case are not guaranteed and are at the sole discretion of HDS. The product must be in the original packaging and packed as received.
A restocking fee of 20% of the purchase price applies (not for warranty claims). The purchaser is responsible for all shipping costs.
DIVEBUDDY and PORTAHOOKAH WARRANTY
For all DIVEBUDDY and Portahookah systems the lithium battery comes with a 12 month warranty, the electrics and the dive compressor also with 12 months warranty from the date of purchase.
NOTE: Warranty applies to manufacture defects only and therefore usually evident within the first hours of use or first times of recharging. Warranty does NOT cover operator neglect or misuse, accident, water damage to the compressor, water damage to the charging port, battery damage due to incorrect charging or running batteries down below 10% charge. Impact damage is not under warranty. For all warranty claims if the claim after inspection is deemed to be caused by the operator, HDS has the right to deny the warranty claim and charge for internal inspection of the system and repair labor and parts.
If the warranty claim is deemed by HDS to be the fault of the manufacturer, we will discuss the most suitable solution to repair or replace the faulty part depending on the location of the purchaser.
